Who needs a Home Information Pack?

Home Information Packs are needed for all homes put on the market on or after 14 December 2007. Whoever is marketing the property is responsible for ensuring a valid Pack is available. In most cases, this will either be the seller or their estate agent.

Exemptions
Since April 6th 2009 the following exemptions apply:

  • properties where there is no marketing, for example if you are selling to a member of your family
  • Non-residential properties
  • Properties limited by law to use as holiday accommodation or occupation for less than 11 months per year
  • Mixed use property sales eg. a shop with flat
  • Sales of portfolios of properties, for example selling two properties together
  • Properties not being sold with completely vacant possession eg. a sitting tenant
  • Unsafe properties and properties due to be demolished
  • Properties sold through the "Right to Buy", "Right to Acquire" and "Social HomeBuy" home ownership schemes


Who can see the pack?

Any potential buyers are entitled to receive a copy of the Pack, or any part of it, if they request it - and they should receive this within 14 days. There is no charge for this, but you can ask buyers to pay a charge to cover copying and postage. This doesn't apply to electronic copies. As the Seller, you should see the Pack for your own home and ensure it is accurate, any estate agents you have instructed should also have access.


When should I order my Home Information Pack?

From April 6th 2009 homes can be no longer be put on the market without a Home Information Pack. Under the latest legislation a HIP must be available to all prospective purchasers on the first day a property is marketed for sale.
If you do not provide a HIP then you or the person marketing the property could face a fixed penalty of £200


What is included in the pack?

The documents that must be in the HIP are:

  • An Index listing the contents of the HIP
  • PIQ - Property Information Questionnaire
  • An Energy Performance Certificate (EPC)
  • A Sale Statement summarising the terms of sale
  • Evidence of title
  • Standard Searches (Local Authority, Drainage and Water)
  • A copy of the Lease (leasehold properties only)


How long does a HIP last for?

As long as your property is actively being marketed, there is no need to update the HIP. If the sale of your property "falls through" and you have to remarket, you may have to compile a new HIP and including up-to-date documents if more than 12 months have passed or there have been substantial changes to any of the information contained within it. However, you can use the same HIP without the need to update any of the documents if:

  • Marketing stopped because an offer was accepted and the sale has collapsed (but remarketing must start within one year of the date when marketing first began or, within 28 days of the original sale falling through)
  • Marketing has stopped for any other reason and the seller remarkets the property within one year of the date when marketing first began.
Effectively this means that a HIP has a shelf-life of at least 12 months for the seller.


How do I order my Pack?

To order you HIP simply call us on 01566 785509 or use our Contact form and we will call you back. Once we have received your instruction we will pass your details on to Quest, who will take your payment. On receipt of funds Quest will commence the search and compilation of all relevant documents needed for your Home Information Pack. We will then contact you directly to arrange your Energy Performance Certificate (EPC) Inspection, if required.

Please note - once payment has been made you can not cancel your HIP or request a refund

Polglase Property subscribe to the HIP code of Practice

Polglase Property (via Quest) are governed by the Hip Code of Practice. The HIP Code provides protection for homebuyers, sellers, estate agents, conveyancers and mortgage lenders who rely on the information included in a Home Information Pack (HIP) provided on residential property within England and Wales.

It sets out minimum standards which HIP providers have to meet. The HIP Code is owned and maintained by the Association of Home Information Pack Providers (AHIPP).

All HIPs which comply with this Code will include the HIP Code logo and you can check whether a HIP provider subscribes to the Code by contacting the Property Codes Compliance Board.
